This is why we only proceed to this stage if confident neither the garnishee nor judgement debtor has valid reasons!<\/p>\n\n\n\n<p>If the court is satisfied, it may then issue a Garnishee Order Absolute.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Stage 3: Secure Garnishee Order Absolute<\/h3>\n\n\n\n<p>This is the final order directing the garnishee to pay you directly.&nbsp;<\/p>\n\n\n\n<p>Depending on the type of garnishee and the nature of money owed, compliance cannot be taken for granted. After months of silence, a Letter of Demand was sent, to which the client issued us a cheque which would be dishonoured upon presentation.<\/p>\n\n    <p>We applied for a Writ of Summons that resulted in a Judgment in Default, and using bank details from the dishonoured cheque, an ex parte Garnishee Order was filed against CIMB, which released the full RM350,000 directly into our account.<\/p>\n  <\/div>\n<\/div>\n\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_to_use_a_garnishee_order\"><\/span>When to use a garnishee order<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A garnishee order is most effective under two conditions:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The judgment debtor has cash funds or receivables held by third parties<\/li>\n\n\n\n<li>The third parties are financially capable of complying with the court order<\/li>\n<\/ol>\n\n\n\n<p><strong>The classic, typical example is when the judgment debtor maintains an account with a bank<\/strong>. In such cases, garnishee orders can be faster and less confrontational than seizing physical assets or initiating <strong><a href=\"https:\/\/www.recoverdebt.my\/bm\/legal-enforcement\/bankruptcy-in-malaysia\/\" target=\"_blank\" rel=\"noreferrer noopener\">bankruptcy<\/a><\/strong> or <strong><a href=\"https:\/\/www.recoverdebt.my\/bm\/legal-enforcement\/winding-up-rules-in-malaysia-2020\/\">winding-up proceedings<\/a><\/strong>.<\/p>\n\n\n\n<p>This is why we <em>always <\/em>conduct preliminary research, and in some cases, recommend starting with a <a href=\"https:\/\/www.rulecolaw.com\/post\/judgment-debtor-summons\" target=\"_blank\" rel=\"noopener\"><strong>judgment debtor summons (JDS)<\/strong><\/a> to force a judgment debtor to disclose their sources of income and assets.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">When other enforcement methods might be better<\/h3>\n\n\n\n<p>For the sake of argument, should investigations reveal the judgement debtor:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>does not have any known bank accounts or potential garnishees, or<\/li>\n\n\n\n<li>primarily stores their wealth in physical assets (e.g. land)<\/li>\n\n\n\n<li>owes multiple creditors in addition to you<\/li>\n<\/ul>\n\n\n\n<p>Alternative enforcement routes may be better, namely a writ of seizure and sale to seize and auction the debtor\u2019s property, or even bankruptcy \/ winding-up proceedings to ensure equitable recovery.<\/p>\n\n\n\n<p>And of course, if a judgement debtor is willing to negotiate, we are firm advocates (literally and figuratively) of out of court settlements at any stage of the process;
