methods to serve a notice on a debtor who is avoiding attempts to be served personally, such as posting the document at the court&#8217;s notice board\u00a0<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span class=\"ez-toc-section\" id=\"Requirements\"><\/span><span style=\"font-weight: 400;\">Requirements<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Section 5 of the Insolvency Act sets out rules for a creditor to file a bankruptcy petition against the judgement debtor or their guarantors.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Main judgement debtor<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Four statutory conditions must be met:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the amount owed is a fixed (liquidated) <\/span><a href=\"https:\/\/www.mdi.gov.my\/wp-content\/uploads\/2025\/04\/Akta-1624-Akta-Insolvensi-Pindaan-2020.pdf\" target=\"_blank\" rel=\"noopener\"><b>sum of at least (currently) RM100,000<\/b><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the debt is undisputed, typically confirmed by an existing judgment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">an Act of Bankruptcy (AOB) occurred within the last six months<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the debtor has a link to Malaysia by living here, owning a home, or doing business<\/span><\/li>\n<\/ul>\n<p><b>Note:<\/b><span style=\"font-weight: 400;\"> The debt threshold of RM100,000 was raised from the previous RM50,000 by the <\/span><a href=\"https:\/\/www.mdi.gov.my\/wp-content\/uploads\/2025\/04\/Akta-1624-Akta-Insolvensi-Pindaan-2020.pdf\" target=\"_blank\" rel=\"noopener\"><b>Insolvency (Amendment) Act 2020<\/b><\/a><span style=\"font-weight: 400;\">, and may be amended in the future.\u00a0<\/span><\/p>\n<p><img decoding=\"async\" class=\"wp-image-2698 aligncenter\" 400;\">high.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Whenever you\u2019re reading, we just have to make sure the debt exceeds the current threshold!<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Guarantors<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If the petition is brought against a guarantor, two additional rules apply:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the court must be satisfied that all other reasonable recovery methods have been exhausted, including bankruptcy or winding-up proceedings against the main debtor<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>social guarantors<\/b><span style=\"font-weight: 400;\"> are protected by statute and cannot be made bankrupt<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If all conditions are met, the creditor must still get the court\u2019s permission before filing a bankruptcy petition against them.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Procedure\"><\/span><span style=\"font-weight: 400;\">Procedure<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Assuming we have determined a case meets all the requirements above, <\/span><b>a bankruptcy proceeding has three main stages<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Serving a bankruptcy notice<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Filing a bankruptcy petition<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Court hearing and bankruptcy order declaration<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">From start to finish,<\/span><b> a straightforward case easily takes several months<\/b><span style=\"font-weight: 400;\">, and complicated cases where the judgement debtor disputes or stays proceedings can take longer still.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Stage 1: Serving a bankruptcy notice<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">At this stage, we <\/span><b>draft and serve the judgement debtor with a bankruptcy notice, giving them seven (7) days<\/b><span style=\"font-weight: 400;\"> to pay the debt in full, negotiate, or dispute the claim.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium 400;\">Debtors who can avoid bankruptcy often settle here, making this the stage most likely for an out-of-court resolution, and as we explain later, the main use of bankruptcy actions.<\/span><\/p>\n<h4><b>Additional step for guarantors<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">If the petition will be against a non-social guarantor, we will also obtain permission from the court to file a bankruptcy notice after all enforcement avenues have been exhausted against the main debtor.<\/span><\/p>\n<p><b>Failure to comply establishes an act of bankruptcy<\/b><span style=\"font-weight: 400;\"> and allows us to move to the next stage.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Stage 2: Filing a creditor\u2019s bankruptcy petition<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If the debtor ignores the notice, we proceed to <\/span><b>file a creditor\u2019s bankruptcy petition in the High Court<\/b><span style=\"font-weight: 400;\">, setting out:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">debt details<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">proof of non-compliance with the bankruptcy notice, and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">your right to request a bankruptcy order<\/span><\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2702 aligncenter\" to be served via substituted service.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Stage 3: Hearing and bankruptcy order<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">At the hearing, the court will consider whether:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the debt is valid and undisputed<\/span><\/li>\n<li bankruptcy order (BO) officially declaring the debtor bankrupt.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This marks the end of the bankruptcy proceeding, but actual debt <\/span><i><span style=\"font-weight: 400;\">recovery <\/span><\/i><span style=\"font-weight: 400;\">is still a ways away.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"After_a_bankruptcy_order_is_declared\"><\/span><span style=\"font-weight: 400;\">After a bankruptcy order is declared<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The moment a BO is declared, the DGI assumes control of all assets belonging to the bankrupt.\u00a0<\/span><span style=\"font-weight: 400;\"><strong>Sections 8, 13, 15, 16, and 17<\/strong> set out the full legal framework for what happens next, but here\u2019s a summary of parts creditors should be aware of, in the correct sequence:\u00a0<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As soon as possible, we file a <\/span><a href=\"https:\/\/www.rulecolaw.com\/post\/proof-of-debt\" target=\"_blank\" rel=\"noopener\"><b>proof of debt (POD)<\/b><\/a><span style=\"font-weight: 400;\"> with the DGI on your behalf<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The bankrupt files an affidavit with the DGI listing their partners, residences, assets, and liabilities<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The bankrupt files a full Statement of Affairs detailing assets, liabilities, creditors, and causes of insolvency<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As fast as possible, the DGI realises the bankrupt\u2019s assets and distributes the proceeds to creditors according to the statutory order of priority<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Regarding Step 4, Section 62 of the Insolvency Act requires the DGI to act as fast as is reasonably possible, and<\/span><b> the first round of payments should be within 12 months of the BO declaration<\/b><span style=\"font-weight: 400;\"> unless there are valid reasons. However, in reality, this timeline may not always be fulfilled.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Creditors\u2019 meeting and public examination (optional)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The DGI may call for a creditors\u2019 meeting or request a public examination in court where the bankrupt is questioned under oath by creditors. This <\/span><i><span style=\"font-weight: 400;\">usually <\/span><\/i><span style=\"font-weight: 400;\">happens right after the BO is declared, though it can be requested any time the DGI wishes to:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">review and consider payment proposals offered by the bankrupt<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">determine how to best deal with the bankrupt\u2019s property<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">understand the wishes of creditors regarding the administration of the estate<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">examine the bankrupt\u2019s conduct, dealings, and property under oath<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">investigate potential misconduct such as <\/span><a href=\"https:\/\/www.rulecolaw.com\/post\/clawback-provisions-in-malaysian-bankruptcy-and-winding-up-laws\" target=\"_blank\" rel=\"noopener\"><b>fraudulent transfers<\/b><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">conduct an official investigation with legal support<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">allow creditors to question the bankrupt<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Order_of_debt_repayment\"><\/span><span style=\"font-weight: 400;\">Order of debt repayment<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><b>After the DGI has first set enough money aside to cover administration costs<\/b><span style=\"font-weight: 400;\">, Section 43 of the Insolvency Act sets out the order in which debts are repaid from a bankrupt\u2019s assets, from highest to lowest priority:<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Tier 1: Preferential debts &amp; administrative costs<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">wages owed for services rendered within five months before the BO<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">employer contributions due within 12 months before the BO<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">tax payable within 12 months before the BO<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">all amounts due under laws relating to workmen\u2019s compensation<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Tier 2: Partnership debts (if applicable)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If the bankrupt is a partner, partnership property is first applied to settle joint partnership debts, while the bankrupt\u2019s personal property is used to settle their personal debts.<\/span><\/p>\n<p><b>Any surplus from either pool is then combined and used to repay remaining debts<\/b><span style=\"font-weight: 400;\">, apportioned according to the partner\u2019s share.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Tier 3: All other unsecured creditors<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">After preferential debts are settled, all other proven debts are paid<\/span><i><span style=\"font-weight: 400;\"> pari passu<\/span><\/i><span style=\"font-weight: 400;\">, meaning creditors in this tier are paid proportionately based on the size of their proven claims.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For most readers, this is the category you likely fall under.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Tier 4: Post-bankruptcy interest<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Any surplus remaining after Tier 1 &#8211; 3 have been paid in full is then used to pay any interest accrued after the date of the BO.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What about secured creditors?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A bankruptcy order <\/span><b>does not affect a secured creditor\u2019s claim on a specific property of the bankrupt<\/b><span style=\"font-weight: 400;\">.
