We were approached by a local fertilizer company that had obtained a judgment of almost RM 20 million for unpaid debt of fertilizer sold to a large, government linked koperasi.
Our Client had successfully obtained a judgment, but their previous lawyer had neglected to advise them on how to “enforce” the judgment, and the judgment was already almost 5 years old; fast approaching the limitation period of 6 years.
We immediately got to work and applied to extend the judgment enforcement period.
Upon successfully obtaining the judgment – we attacked the koperasi from multiple angles – garnishing their bank accounts; seizing assets and items at their premises and also instituting Judgment Debtor Summons proceedings against the officers of the koperasi.
After a long fought battle involving multiple interlocutory applications, delays, appeals and other tactics from the Judgment Debtor; we finally obtained an order from the Court to compel the debtor to pay a sizable monthly instalment to our Client; failing which the debtors’ officers would be committed to prison.
The case was fought over a lengthy period of almost five years; and remains our magnum opus. Our Client is now consistently receiving large monthly repayments towards the judgment debt; when it initially almost wrote off the RM 20 million as an irrecoverable bad debt.
